Hereinafter referred to as "FLAXX RACKETS", "we" or "us".

General

These terms and conditions apply to all orders submitted through the FLAXX RACKETS online store at www.flaxx.be(hereinafter referred to as the "online store"). They cover all purchase agreements made by a consumer with FLAXX RACKETS. We recommend that you read these terms and conditions in full before placing an order. These terms may be updated from time to time, so we ask you to review them with each order placed in the online store. The last modification date can be found at the bottom of this page.

A binding purchase agreement is formed as soon as your order is confirmed by us and an order confirmation is sent to the email address you provided. FLAXX RACKETS reserves the right to refuse or cancel a purchase agreement if fraud or other fraudulent activities, such as unauthorized use of another person’s credit card, are suspected.

To place an order in the online store, you must be at least 18 years old and not under guardianship. FLAXX RACKETS assumes that minors making purchases on www.flaxx.be provide truthful information regarding their age and/or have the necessary consent from their guardian to buy the product. Otherwise, the buyer may be held liable for any costs arising from an invalid agreement.

Right of Withdrawal

There is no right of withdrawal on custom-made products purchased from FLAXX RACKETS. For other products, the following applies:

You have the right to withdraw from your purchase within 14 days of receiving the item. If the returned goods have been handled more than necessary to establish their nature and function, the consumer will compensate us for any depreciation in value. The extent of the depreciation will be determined by FLAXX RACKETS.

The right of withdrawal can be exercised provided that the product is returned with its original labels and packaging. As a customer, you have the right to inspect the product, but you must not break any seals. In cases where the corresponding packaging, information booklet, or authenticity certificate is missing when exercising the right of withdrawal, FLAXX RACKETS reserves the right to refuse the return. The same return procedures apply for goods delivered via home delivery as for other shipping methods.

Returns

There is no return right on custom-made products purchased from FLAXX RACKETS. For other products, the following applies:

You may return your goods to FLAXX RACKETS within 14 days and receive a refund if you regret your purchase. The cancellation period starts on the day you receive your order. The cost of return shipping is paid by you, the customer, including any customs duties, taxes, and other charges.

In the case of an incorrect shipment, you can choose between a new item or a full refund.

All returned goods must be carefully packaged to avoid damage. You, as the customer, are responsible for the risk of transport back to FLAXX RACKETS.

Complaints

If you file a complaint about your product due to damage or a manufacturing defect, we will conduct a manual review and request the product if necessary.

The first obligation in case of a complaint is to remedy the problem. If this is not possible and the complaint is approved, we will send you a new product.

If we cannot provide you with a similar item, you have the right to cancel the purchase and receive a refund.

Refunds are usually processed within 14 working days from the moment we have received and approved your return. We can only issue a refund in the same manner and to the same account used for the original purchase.

Shipping

FLAXX RACKETS processes orders in the order they are submitted in the online store. The delivery date is the day the item is available for pickup. Typically, the delivery time is around 6 weeks. These products are handmade, which means delivery may take longer. Orders are delivered free of charge, unless customs duties, taxes, or other fees need to be paid, in which case the customer is responsible for covering these costs.

Unclaimed Packages

If a purchase that has been sent to you is returned as undeliverable, we reserve the right to charge you a fee covering the full shipping and handling costs. Unclaimed packages generally do not fall under the right of return.

Delays

If your order is delayed, you will be informed, including a new proposed delivery date. You can cancel the order if you do not accept the new proposed delivery date.

Transport

All shipped items are insured by FLAXX RACKETS. If you discover damage to the package before opening it, report it as soon as possible to us via info@flaxx.be and to the postal agent who delivered the package. Items damaged during transport will be replaced free of charge.

Claims

The warranty covers goods that are defective according to applicable consumer protection laws. However, the warranty never covers goods that have been carelessly used or have been damaged in a way that is not compatible with normal use. It is up to FLAXX RACKETS to determine whether this is the case.

Force Majeure

In the case of force majeure, the obligations of FLAXX RACKETS are postponed. We reserve the right to terminate the agreement without any obligation to pay damages in cases of force majeure, which include war, strikes, employee illness, transport disruptions, and import/export bans.

Payments

Payments can be made using credit cards such as Mastercard or Visa or through PayPal. FLAXX RACKETS reserves the right to check the cardholder’s address, the validity of the card, and whether your account can be charged with the full amount.

Prices

The prices in our online store include VAT. Outside the European Union, customs duties or other taxes and fees may be added to the purchase price.

Order Confirmation
